Vice Chair Myers Votes with ACC to Repeal Outdated Energy Efficiency Mandate

Phoenix, Ariz.— At the Arizona Corporation Commission’s (ACC) September 17, 2025, regular open meeting, Vice Chairman Nick Myers joined the Commission in a 5-0 vote to direct ACC Staff to file a Notice of Proposed Rulemaking with the Secretary of State’s Office to repeal the Electric Energy Efficiency Mandate (A.A.C. Title 14, Chapter 2, Article 24).

The Commission adopted the Electric Energy Efficiency Mandate (EE Mandate) in 2010, requiring retail electric utilities to achieve 22% of annual EE savings as a percentage of retail energy sales by 2020.

“I believe it’s time for the Commission to move forward and repeal this outdated one-size-fits-all mandate from 2010 that has subsidized certain industries at the expense of ratepayers,” said Vice Chair Myers. “Current Demand-Side Management and EE programs will continue in effect and will be evaluated on a case-by-case basis by the Commission. These programs, when properly structured, play an important role in our utilities’ energy mix and certainly fit within the Commission’s all-of-the-above approach when it to comes to meeting Arizona’s energy needs.”

The Commission will hold two oral proceedings to receive public comment on the repeal of the EE Mandate on December 2 and December 4 at the ACC’s Phoenix office. Interested persons may file written comments with the Commission’s Docket Control (RE-00000A-24-0025) by December 4, 2025, and may provide oral comments at the proceedings held on December 2 and 4, 2025.
