Phoenix, Ariz. — At the Arizona Corporation Commission’s (ACC) June 11, 2025, regular Open Meeting, Vice Chair Nick Myers voted with the Commission (5-0) to authorize the Office of General Counsel, on behalf of the Commission, to file a notice of intervention and comments at the Federal Energy Regulatory Commission (FERC) in support of the Interstate Natural Gas Association of America’s (INGAA) petition to rescind Order No. 871 under RM25-9.
INGAA’s petition, filed on April 14, 2025, aims to halve the time it takes to permit and build natural gas infrastructure across the United States. Vice Chairman Nick Myers had requested this item on the agenda arguing that “it is important for the Commission to discuss INGAA’s petition because this matter is ultimately about ensuring our state and nation can meet the energy demands of today and tomorrow.”
FERC Order No. 871, initially adopted in 2020, automatically delays construction on natural gas projects certified under Sections 3 and 7(c) of the Natural Gas Act (NGA) until any potential requests for rehearing are resolved. According to INGAA’s petition, the result has been a doubling of the time from certification to construction—a bottleneck INGAA contends is inconsistent with the Trump Administration’s “effort to unleash American energy dominance by facilitating the development of needed energy infrastructure.”
“I fully support the Trump Administration’s energy policy, prioritizing American energy dominance by cutting red tape and accelerating infrastructure development,” concluded Vice Chairman Myers. “Therefore, I’m pleased the Commission voted today to support the repeal of FERC Order No. 871.”
At yesterday’s open meeting, the Vice Chair also voted with his fellow Commissioners in a 5-0 vote to take the next step in repealing the outdated Gas Energy Efficiency mandate imposed in 2010. The mandate requires gas utilities to achieve an increasing cumulative annual energy savings through December 31, 2020. The Commission directed Commission Utility Staff in February 2024 to initiate the process of proposing a repeal of the Gas EE Rules. This latest vote approved Staff’s proposed draft repealing the Gas EE Rules and directed Staff to file a Notice of Proposed Rulemaking with the Office of the Secretary of State by July 11, 2025.
“Repealing this outdated Gas EE mandate is the right decision,” stated Vice Chair Myers, “Energy efficiency programs can be effective if structured properly; however, mandates like this one often result in subsidies and uneconomical investments which unnecessarily drive up rates for customers.”
